A lifeguard who has worked for Ocean City Beach Patrol for over 20 years has filed a class action lawsuit against Ocean City for unpaid overtime.   The overtime lawsuit against Ocean City Beach Patrol is filed in state court because it being brought under state law.  The Pennsylvania Overtime law mirrors the Federal Fair Labor Standards Act (FLSA) in many ways. Just like the FLSA, the Pennsylvania overtime law requires that non-exempt employees receive overtime pay equal to 1.5 x their regular hourly pay for any hours worked over 40 in a week (overtime).  The class action overtime lawsuit covers over 100 lifeguards that have been misclassified as exempted by Ocean City Beach Patrol and denied overtime pay.
